Subject: Canada (Quebec) – Approved to Repeal the Act Respecting Stuffing and
The Quebec government has passed Bill 103, which amend or repeal various Acts. The “Act respecting stuffing and upholstered and stuffed articles (chapter M-5)” was repealed starting from 9 December 2021.

Subject: Canada (Quebec) – Proposed to repeal the Act respecting stuffing and upholstered and stuffed articles (chapter M-5)
In order to reduce the number of management formalities that business must completed, the Quebec government has proposed a bill to amend or repeal various Acts. The “Act respecting stuffing and upholstered and stuffed articles (chapter M-5)” would be repealed once the bill is passed.

Intertek reminder:
The repeal in Quebec followed a similar decision in two other Canadian provinces, Manitoba and Ontario, where filled products are no longer required to be labeled or licensed. That means filled products are no longer required to be labeled or licensed for all provinces in Canada.

For your reference, we have included the implications of the repeal below.

1. Product fill and products with hidden stuffing are no longer required to be licensed in Quebec.
2. Products with hidden stuffing (e.g., upholstered products and stuffed toys) are no longer required to be labeled.
3. If you hold a license in Quebec, you can safely allow it to lapse. Going forward, Quebec will no longer be issuing new or renewed licenses.
