The Governor of the Commonwealth of Massachusetts has signed Bill H.4900 into law to restrict the flame retardant content in certain consumer products. The restriction shall apply to covered products that are manufactured on or after 1 January 2022.The new law shall apply to:

1. Bedding
2. Carpeting
3. Children’s product
4. Residential upholstered furniture
5. Window treatment

However, it shall not apply to:

1. Covered products that contain restricted flame retardants due to the presence of recycled materials used during manufacture
2. Products in motor vehicles, watercraft, aircraft, all-terrain vehicles, off-highway motorcycles or any component parts
3. Products in the sale or purchase of any previously owned product containing a restricted chemical flame retardant

Any component of a covered product shall not contain any of the following flame retardants which exceeds 1000 ppm by weight.

A manufacturer of a covered product that contains a restricted chemical flame retardant shall provide notice to retailers and other persons that sell covered products in the Commonwealth of the passage of the law on or before 1 July 2021.

Note:

1. “Bedding” means any bedding material including, but not limited to, a mattress, mattress pad, mattress cover, sheeting, pillow, blanket, comforter, duvet cover, sleeping bag or any other stuffed item intended to be used for reclining or sleeping.
2. “Carpeting” means any fabric floor covering, including carpet padding.
3. “Children’s product” means a consumer product intended, made or marketed for use by children 12 years of age or under.
4. “Residential upholstered furniture” means seating or other upholstered products intended for indoor or outdoor use in or at a home or other dwelling intended for residential occupancy that consists in whole or in part of resilient cushioning materials enclosed within a covering consisting of fabric or other textile.
5. “Window treatment” means curtain materials, blinds or shades.
