On 14th August 2023, the Ministry of Human Resources and Social Security, the Ministry of Public Security, and other five departments jointly issued the System for Preventing and Eliminating Risks and Hazards of Improper Management in Workplace (Reference Text) (hereinafter referred to as the System).
The System lists the hidden hazards and risks of improper management that enterprises should focus on avoiding in the operation of recruiting workers, paying labor remuneration, arranging overtime work, and handling resignation procedures.
The System provides reference for guiding employers to formulate and improve relevant rules and regulations or when signing labor contracts or collective contracts with employees. Employers can further refine and improve the relevant content of the reference text based on local regulations and actual conditions.
2. < Regulations on the Management of Human Resources Service Agencies > (2023-08-01)
The Ministry of Human Resources and Social Security issued the Regulations on the Management of Human Resources Service Agencies (hereinafter referred to as the Regulations) on 29th June 2023, which has been come into effect on 1st August 2023. The Regulations apply to human resource service agencies engaged in human resource service activities within the territory of China.
Key specifications of the Regulations:
- Strengthen recruitment service management. For example, service agencies shall review the authenticity and legality of the materials provided by employers in accordance with the law.
- Clarify prohibited behaviors in the service. For example, service agencies are not allowed to forge, alter, or transfer human resources service licenses, provide career intermediary services to employers without legal licenses, and introduce minors under the age of 16 to employment.
- Strengthen personal information protection. For example, service agencies shall take necessary measures to prevent illegal activities such as theft, trafficking, and leakage of personal information.
- Standardize service fees and fair competition. For example, the Regulations stipulated that individuals shall not be charged service fees stated in the name of providing recruitment services other than those explicitly.
- Standardize other related service activities. For example, when carrying out human resource service outsourcing, it is not allowed to assist employers in avoiding the main responsibility of the employer or colluding with employers to infringe on the legitimate rights and interests of employees by registering individual businesses or other means.

1. < Measures for the Management of the List of Serious Dishonesty Subjects in Safety Production > (2023-10-01)
The Measures for the Management of the List of Serious Dishonesty Subjects in Safety Production (hereinafter referred to as the Measures) were issued by the National Emergency Management Department on 17th July 2023, and will come into force since 1st October 2023. The relevant content of the Measures is as follows:
- The Measures include dishonest behaviors with serious characteristics such as seriously endanger the safety of the people's lives, refuse to fulfill legal obligations, etc. as conditions for inclusion in the list.
- The Measures strictly implement the procedures for identifying the list of severely dishonesty entities and protect the legitimate rights and interests of market entities and relevant personnel.
- In order to encourage listed objects to actively correct mistakes and reshape their credit, and stimulate the vitality of market entities, the Measures clarify the conditions and procedures for credit repair, which not only reflect effective punishment for listed objects, but also provide opportunities for listed objects to reshape their credit and reform themselves.
2. < Management measure for fire safety of leased factories and warehouses (Trial) > (2023-07-14)
The Management measure for fire safety of leased factories and warehouses (Trial) (hereinafter referred to as the Measures) was reviewed and approved by the National Fire and Rescue Administration on 10th July 2023, and was issued and implemented since 14th July 2023. The relevant content of the Measures are as follows:
- The Measures not only determine the subject of fire safety responsibility, but also clarify the form of responsibility determination and the responsibility for financial security.
- The Measures stipulates that the lessor, who as the owner of the leased factory and warehouse, shall be responsible for the fire safety of the leased factory and warehouse in accordance with the law.
- The Measures stipulate that the lessee shall bear fire safety responsibilities equivalent to its right of use in accordance with the law, including the implementation of the fire safety responsibility system and the formulation of fire safety regulations and safety operation procedures; ensure unobstructed fire exits and fire-fighting facilities are in good condition and effective; carry out fire safety publicity and education, and regularly conduct fire drills.
- The Measures require the implementation of unified management, strict technical requirements, establishment of collaborative extremes, and classified storage for "factory in factory" and "warehouse in warehouse".

1. < Technical specification for application and issuance of pollutant permit - Industrial noise (HJ 1301-2023) > (2023-10-01)
The Technical specification for application and issuance of pollutant permit - Industrial noise (HJ 1301-2023) (hereinafter referred to as Specification) has been gazetted by the Ministry of Ecology and Environment on 4th August 2023 and will come into force since 1st October 2023, the main characteristic and contents are as follows:
1.The Specification shall be coordinated with the existing technical specification system for emission permits.
- First, highlight the characteristics of industrial noise and introduce the concept of noise generating unit.
- Second, differentiated management, encourage typical cases to demonstrate and lead, from the perspective of positive guidance and encouragement of industrial noise pollution prevention, put forward the basic situation exemption.
- Third, scientifically determine allowable emission limits of industrial noise based on emission standards.
- Fourth, propose technical requirements for pollution prevention and control according to the characteristics of industrial noise and simplify the requirements for environmental management ledger records.
2.The Specification provides pollutant emission unit of industrial noise with the requirements on declaration of general information, determination method of permitted emission limits of industrial noise, the environmental management requirements on self-monitoring, environmental management ledger and the implementation report on pollutant permit, feasible technical requirements on pollution prevention and control, and determination method of compliance.
3.The Specification is applicable to guide the pollutant emission unit of industrial noise filling in the relevant application information of pollutant permit of industrial noise; suitable for guide the examination and approval department to examine and decide the management requirements for the pollutant permit of the pollutant emission unit of industrial noise; It is applicable to pollutant emission unit of industrial noise that is required to apply for pollutant permit in accordance with the law.
4.The Specification includes four informative Appendices:
- Main noise emission facilities and main noise pollution prevention and treatment facilities.
- Pollutant permit application form template (Industrial Noise).
- Environmental Management Ledger Record Reference Table (Industrial Noise).
- Annual Pollutant Permit Implementation Report template (Industrial Noise).
